Terms and Conditions

a) General Eligibility

• You must be at least 16 years of age, or the minimum age required to lawfully consent to use online services in your country of residence (if higher), to use this platform. By using ShowUs, you represent and warrant that you meet this requirement.
• All contests and challenges are open to eligible users who comply with these Terms and the laws applicable to them locally.
• We reserve the right to verify your age and eligibility at any time and to suspend or terminate accounts that do not meet eligibility requirements.

b) Minor Access Clause (Ages 16 and 17)

• Users aged 16 or 17 confirm by registering that their parent or legal guardian has reviewed these Terms and the Privacy Policy and has given explicit consent for them to participate.
• Parents and guardians retain the right to request access to, correction of, or deletion of their child's personal data at any time by contacting our Data Protection Liaison at showus25@gmail.com.
• ShowUs reserves the right to require additional verification of parental consent where there is reason to believe a user may be under 18.
• Users under the age of 16 (or the applicable local minimum, if higher) are strictly prohibited from using this platform under any circumstances. If we discover that an account belongs to an ineligible user, we will immediately terminate it and delete all associated data.

c) School and Institutional Partnerships

• Where ShowUs partners with schools, colleges, or educational institutions for contests (e.g., inter-school competitions), the participating institution acts as a proxy consent provider. By joining as a partner institution, the school confirms that it has collected the necessary parental or guardian consent for all participating students in accordance with the law applicable to it.
• ShowUs will require a written or digital confirmation from partner institutions that such consent has been obtained before activating any school-based contest.

• Users must create an account to create contests, submit entries, or send gifts. Voting may be available to both registered and unregistered users depending on contest settings.
• Each user is permitted one account only. Creating multiple accounts, using fake identities, or engaging in fraudulent activity will result in immediate disqualification and account termination.
• You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at showus25@gmail.com if you suspect unauthorised access to your account.
• You agree to provide accurate, complete, and current information when registering and to keep your account information updated at all times.
• You are solely responsible for all activity that occurs under your account.
• For users aged 16 or 17, the parent or guardian who provided consent shares responsibility for ensuring the account is used in accordance with these Terms.

• Registered users may create contests on the platform and are solely responsible for the content, management, and outcomes of their contests.
• ShowUs acts as a platform provider and does not endorse, sponsor, or guarantee any user-created contests. We are not a party to any contest between a creator and its participants.
• Contest creators must ensure their contests comply with all laws applicable to them, including advertising standards, consumer protection laws, and applicable data protection law (such as the NDPA 2023 in Nigeria, the GDPR in the EU/UK, or comparable laws elsewhere).
• Contest creators must not post content that is illegal, offensive, defamatory, sexually explicit, or that infringes on any intellectual property or privacy rights.
• Contest creators running contests that are open to or targeted at minors must ensure that appropriate safeguards are in place, including limiting data collection and confirming that participating minors have parental consent.
• ShowUs reserves the right to remove, modify, suspend, or cancel any contest at any time and without notice if it violates these Terms or is otherwise deemed inappropriate at our sole discretion.

• Participants must comply with all contest-specific rules as set out by the contest creator.
• Automated voting, vote manipulation, use of bots or scripts, proxy voting, or any other method designed to artificially inflate vote counts is strictly prohibited and will result in disqualification and account suspension.
• Voting periods and methods will be clearly specified for each contest. Votes cast outside the specified period will not be counted.
• ShowUs reserves the right to review, adjust, or invalidate votes at any time in cases of suspected fraud, manipulation, technical errors, or platform abuse. Our decisions in such matters are final.
• We may implement fraud detection measures, including device fingerprinting and IP analysis, to protect the integrity of all contests, gifting, and Spotlight features. These measures are described further in our Privacy Policy.

• Contest entries must be submitted within the time frame specified by the contest creator.
• Entries — whether a photo upload or a video submitted via link — must be original works created by the submitting user and must not infringe on the intellectual property rights, privacy rights, or any other rights of third parties.
• By submitting an entry, you confirm that you have all necessary rights, permissions, and licences to submit it and to grant ShowUs the rights described in Section 12 (User Content Licence).
• Entries involving third parties (e.g., group photos or videos featuring other individuals) must only be submitted with the informed consent of all identifiable persons featured. For minors featured in any submission, parental or guardian consent is required.
• ShowUs reserves the right to disqualify any entry that violates these Terms, is offensive, illegal, or otherwise deemed inappropriate at our sole discretion.

• Winners are determined based on voting results or contest-specific criteria established by the contest creator, including any tie-breaking criteria.
• In the event that a winner is disqualified, ShowUs or the contest creator may select an alternate winner at their sole discretion.
• Prizes are non-transferable, non-exchangeable, and subject to availability unless otherwise stated by the contest creator.
• ShowUs does not guarantee the availability, fulfilment, or delivery of any prizes. Contest creators and/or their sponsors are solely responsible for prize fulfilment unless ShowUs has explicitly stated otherwise in writing.
• ShowUs is not liable for any failure of a contest creator to deliver prizes to winners.

• Gifting allows users to send virtual gifts to contestants as a sign of support, separate from voting.
• Only registered, logged-in users may send gifts. Visitors who have not created an account cannot send gifts, even if they are able to vote.
• Daily and weekly limits apply to the value or number of gifts a single user may send. Current limits are displayed on the platform at the point of sending a gift, and we may adjust them at any time to maintain fairness and platform integrity.
• Gifts received by a contestant are subject to a holding period (typically 3 to 7 days) before they become eligible to be claimed or converted.
• Before claiming or converting received gifts, contestants must complete identity verification. ShowUs reserves the right to withhold, delay, or deny the release of gifts where identity verification cannot be completed, where information provided is inaccurate, or where fraud is suspected.
• Gifts and any associated value are non-refundable once sent, except where required by applicable law.
• ShowUs reserves the right to reverse, suspend, or cancel any gifting transaction it reasonably believes to be fraudulent, erroneous, or in violation of these Terms.
• Gifting is a feature for supporting contestants. It is not an investment product, and gift values do not constitute or guarantee any particular cash return.

• Spotlight is a paid feature that lets contestants boost the visibility of their contest entry, with options for country-wide or worldwide placement.
• Spotlight purchases are processed through our designated payment partners and are non-refundable once activated, except where required by applicable law.
• Spotlight increases visibility but does not guarantee votes, gifts, contest placement, or any particular outcome.
• ShowUs reserves the right to modify, suspend, reprice, or discontinue Spotlight placements or availability at any time.

• Some contests are restricted and require a join code provided by the contest organiser to enter.
• Contest organisers running private or invite-only contests are responsible for controlling distribution of join codes and for ensuring all participants meet these Terms, including age and parental consent requirements.
• ShowUs is not responsible for the unauthorised sharing or leaking of join codes by organisers or participants.

• All platform content, design, software, trademarks, and logos owned by ShowUs are protected by intellectual property laws. You may not reproduce, distribute, or use them without our express written permission.
• Users retain ownership of original content they submit to the platform.
• Unauthorised use, copying, or redistribution of any contest content is prohibited and may constitute copyright infringement under applicable national and international law.

You agree not to:

• Use the platform for any unlawful, harmful, or fraudulent purpose.
• Post or transmit any content that is hateful, defamatory, obscene, sexually explicit, or that promotes violence or discrimination.
• Post, upload, or share any content involving minors in a sexualised, exploitative, or inappropriate manner. Violations will be reported to the relevant law enforcement authorities.
• Attempt to gain unauthorised access to any part of the platform or any other user's account.
• Use bots, scrapers, or automated tools to access or interact with the platform without our written permission.
• Interfere with or disrupt the integrity or performance of the platform or its infrastructure.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Collect or harvest any personal data from the platform without authorisation.
• Attempt to circumvent gifting limits, Spotlight rules, or identity verification requirements.

By submitting, posting, or uploading any content (including photos, videos, text, usernames, or profile images) to ShowUs, you grant ShowUs a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, display, reproduce, distribute, adapt, and promote such content in connection with operating and marketing the platform, including in social media posts, promotional materials, and advertising.

This licence does not affect your ownership of your content. You may remove your content from the platform at any time, subject to our data retention policy, and the licence will terminate with respect to content you remove, except where it has already been shared or distributed.

For users aged 16 or 17, this licence is granted subject to the parental or guardian consent described in Section 1(b).

• ShowUs may display advertisements served by third-party advertising networks. These ads are governed by the respective networks' own terms and policies.
• Third-party advertising networks may use cookies and tracking technologies as described in our Privacy Policy.
• ShowUs is not responsible for the content, accuracy, or practices of any third-party advertisements or linked websites.
• Clicking on third-party ads may result in you leaving our platform. We encourage you to review the terms and privacy policies of any third-party sites you visit.
• Users aged 16 or 17 will not be subject to personalised or behavioural advertising. Any advertising displayed to minor users will be contextual and non-personalised only.

ShowUs is committed to protecting your personal data in accordance with the laws applicable to you. Depending on your country of residence, this may include the Nigeria Data Protection Act (NDPA) 2023, the EU/UK General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), or other applicable regional privacy laws. The following provisions apply to all users:

• Your personal data is processed lawfully, fairly, and transparently, in accordance with the purposes described in our Privacy Policy.
• We collect only the minimum personal data necessary for the purpose for which it is processed (data minimisation).
• Your personal data will not be retained for longer than is necessary for its original purpose.
• You have the right to access, correct, delete, port, or object to the processing of your personal data at any time. Exercise these rights by contacting our Data Protection Liaison at showus25@gmail.com.
• You have the right to withdraw consent to data processing at any time, without prejudice to the lawfulness of processing that occurred before withdrawal.
• In the event of a personal data breach that poses a risk to your rights, ShowUs will notify affected users and the relevant supervisory authority (such as Nigeria's NDPC, where applicable) without undue delay.
• If you believe your data rights have been violated, you may file a complaint with the data protection authority in your country of residence — for example, the Nigeria Data Protection Commission (NDPC) at ndpc.gov.ng, or your local EU/UK or other regional authority, where applicable.

Your use of ShowUs is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. Our Privacy Policy includes specific provisions for users aged 16 and 17, including parental rights and data minimisation obligations.

• ShowUs provides the platform on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee uninterrupted, error-free, or secure access to our platform and may modify, suspend, or discontinue any part of the service at any time without notice.
• ShowUs is not responsible for the accuracy, completeness, or legality of any user-generated content, contest, or prizes.
• ShowUs is not liable for any damages arising from your participation in, voting in, gifting on, or creation of any contest on the platform.
• To the maximum extent permitted by applicable law, ShowUs and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of or inability to use the platform, even if ShowUs has been advised of the possibility of such damages.
• Nothing in these Terms excludes liability which cannot be lawfully excluded under the consumer protection or data protection laws of your country of residence.

• ShowUs reserves the right to suspend or terminate any user account at its sole discretion, without prior notice, if a user violates these Terms, provides false eligibility information, engages in fraudulent activity, manipulates contests, votes, or gifts, harasses other users, or otherwise abuses the platform.
• Upon termination, your right to use the platform immediately ceases. ShowUs may retain your data only as required by law or for legitimate business purposes as described in our Privacy Policy.
• You may delete your account at any time through your profile settings. Deletion requests are processed in accordance with our data retention policy.
• Parents or guardians may request the deletion of a minor user's account at any time by contacting our Data Protection Liaison at showus25@gmail.com.
• ShowUs is not liable to you or any third party for any suspension or termination of your account carried out in accordance with these Terms.

• ShowUs reserves the right to update or modify these Terms and Conditions at any time.
• When changes are made, we will update the "Last Updated" date at the top of this page and, where appropriate, notify users via email or a notice on the platform.
• Continued use of the platform after any changes have been posted constitutes your acceptance of the revised Terms. If you do not agree with any updated Terms, you must stop using the platform.
• For users aged 16 or 17, material changes to these Terms will be communicated to the parent or guardian email address on record where practicable.

• These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, where ShowUs is operated from, without regard to its conflict of law provisions.
• This does not deprive you of any protections you are entitled to under the mandatory consumer protection or data protection laws of your own country of residence, where those laws cannot be excluded by agreement (for example, certain rights available to consumers in the EU, UK, or elsewhere).
• Any disputes arising out of or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Nigeria, except where the law of your country of residence requires that you be permitted to bring a claim before your local courts.
